Terms of Service
Last updated: October 26, 2026
1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of Quiet Winners, including our website, leaderboard, reports, and emails (the “Services”), operated by Foremind, LLC (“Quiet Winners,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or buy a plan. You can sign in with your Google account or with a one-time code sent to your email address; we never see or store your Google password. While sign-ups are invite only, you can create an account only with an email address on our invitation list. Your account is personal to you: you may not share, sell, or transfer it, or let anyone else use it.
You are responsible for all activity under your account, so keep your email and Google account secure and tell us right away at support@quietwinners.com if you suspect unauthorized use. You agree to receive emails about your account, such as sign-in codes, billing notices, and renewal reminders, at the email address on your account. Accounts also receive each new leaderboard issue by email, which you can unsubscribe from at any time, as described in our Privacy Policy.
3. The Services
Quiet Winners studies websites that grow without much noise and explains how they do it. The Services include a regularly updated leaderboard of websites and a research report on each of them. Every report has an overview and a full report. Some content is open to everyone, some requires a free account, and the full leaderboard, every site’s overview, and full reports require a paid plan, as described on our pricing page.
Reports are produced with automated research and analysis systems, including AI models, that gather and analyze publicly available information and data from third-party providers. We update reports when we have new information, and the features, content, and prices of the Services may change over time.
4. Reports Are Research, Not Advice
Reports, scores, estimates, and other content on the Services are for general information and research. They are not investment, financial, legal, tax, or other professional advice, and they are not a recommendation to buy, sell, build, or invest in anything.
Reports describe websites and businesses that we do not own or control, based on information that can be incomplete, outdated, or wrong. Factual statements link to the sources we relied on. Scores, estimates (for example, of traffic, revenue, or growth), playbooks, and recommendations are our analysis and opinion, not verified facts. Check important information yourself before you rely on it.
Unless we say otherwise, the websites, businesses, and people covered in our reports are not affiliated with us and have not endorsed us or our reports. Their names, trademarks, logos, and screenshots belong to their owners and appear only to identify them and to support our research, commentary, and analysis.
5. Unlocks and Access to Full Reports
Paid plans include a number of unlocks each month, shown on our pricing page. One unlock opens one site’s full report, including later updates to that site’s report. Unlocks are granted at the start of each monthly period, on annual plans too, and unused unlocks expire when the next monthly grant arrives. When you upgrade, you receive extra unlocks for the rest of the current month, which expire at the same time. Unlocks included with a plan can be used only while that plan is active. Unlocks we give you as a courtesy do not expire unless we say so when we give them.
A report you unlock stays available to you after your plan ends, for as long as your account is open and we offer that report. The one exception: if the first payment of a subscription is refunded, reports unlocked with that subscription’s unlocks are removed (see Section 7). We may correct, update, or withdraw a report, for example to fix errors or for legal reasons; a withdrawn report is no longer available, including to people who unlocked it.
Unlocks are a limited license to access reports. They have no cash value, cannot be transferred or sold, and cannot be exchanged for money.
6. Subscriptions, Payments, and Promotions
Paid plans are billed monthly, or once a year for annual plans, in U.S. dollars, and renew automatically at the end of each billing period until you cancel. Prices, the unlocks included with each plan, and any applicable taxes are shown on our pricing page and at checkout.
You can change or cancel your plan anytime from your billing settings. Upgrades take effect immediately: you pay a prorated amount for the rest of the current billing period and receive extra unlocks as described in Section 5. Downgrades, switches from annual to monthly billing, and cancellations take effect at the end of the current billing period, and you keep your current plan until then. If you are on an annual plan, we will email you a reminder before it renews.
Payments are processed by our payment processor, Stripe; your card details never touch our servers. If a renewal payment fails, we may retry the charge, and your plan may end if payment is not completed. We may change plan prices with advance notice; new prices apply from your next billing period, and you can cancel before they take effect.
Promotion codes and offers are subject to the conditions stated with them, have no cash value, and may be changed or withdrawn at any time.
7. Cancellations and Refunds
You can cancel anytime to stop future renewals, and you keep your plan until the end of the period you paid for. Refunds work as follows:
- First payment. If you are not happy with a plan, email us within 14 days of a subscription’s first payment and we will refund that payment in full. We then end the subscription right away, and reports unlocked with its unlocks, along with its unused unlocks, are removed.
- Annual renewals. You can request a full refund within 14 days after an annual plan renews. We then end the subscription right away. Reports you have already unlocked stay available, and unused unlocks are removed.
- Everything else. Other charges, including monthly renewals and prorated upgrade charges, are non-refundable, except where required by law.
To request a refund, email support@quietwinners.com from the email address on your account. Refunds go back to the original payment method. We may decline requests that abuse this policy, such as repeated cycles of subscribing and asking for a refund, unless the law requires otherwise. Nothing in these Terms limits any rights you have under consumer protection laws that apply to you.
If you believe you were charged in error, contact us within 30 days of the charge and we will look into it. Please reach out to us before disputing a charge with your bank; while a dispute is open, we may suspend the related account.
8. Acceptable Use
You may not:
- Share your account or sign-in, or let anyone else use your plan, unlocks, or access;
- Copy, download in bulk, republish, sell, sublicense, or otherwise distribute full reports, the leaderboard, or data from the Services, or make them available to others, except as allowed below;
- Access or collect content from the Services with bots, scrapers, crawlers, or other automated tools, or get around our paywall, unlock limits, or other access controls;
- Use content from the Services to train or fine-tune AI or machine learning models, to build datasets, or to build a product or service that competes with us;
- Create multiple accounts to get extra benefits, or abuse refunds or promotions;
- Use the Services to harass, defame, or harm anyone, including the people and businesses covered in our reports;
- Reverse engineer, disrupt, or interfere with the Services, or break any law while using them.
You may share links to our pages and quote short excerpts for commentary or discussion, as long as you credit Quiet Winners and link to the page you quote.
Full reports include invisible markers tied to the account that opened them, so we can tell where copied text came from. If you break these Terms, we may remove your access to reports, revoke unlocks obtained through abuse, and suspend or terminate your account.
9. Our Content and Your License
The Services, including the reports, leaderboard, scores, data, text, design, software, and the Quiet Winners name and logo, are owned by us or our licensors and are protected by law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to access and read the content available to you, for your own personal or internal business purposes. Your plan does not include any right to export data from the Services, or to republish, resell, or use our content in products or services you offer to others.
Third-party material shown in reports, such as screenshots, quotes, and trademarks, belongs to its owners. Your license to it is limited to reading it as part of our reports.
10. Feedback
If you send us feedback or suggestions, we may use them to improve the Services without any obligation to you.
11. Corrections and Copyright Complaints
If you believe something in a report is inaccurate, or you are a person or business covered in a report and have a concern, email support@quietwinners.com with a link to the page and what you think is wrong. We review every request and correct or update the report when the evidence supports it.
We respect intellectual property rights and respond to notices of alleged copyright infringement consistent with the Digital Millennium Copyright Act (DMCA). To report material on the Services that you believe infringes your copyright, email a written notice to support@quietwinners.com. Your notice must include:
- Your physical or electronic signature;
- Identification of the copyrighted work you believe is infringed;
- Identification of the material you believe is infringing and where it is on the Services, such as the page address;
- Your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
If material you provided was removed in response to a notice and you believe that was a mistake or misidentification, you may send a counter-notification that meets the DMCA’s requirements to the same address. We may remove or disable access to material in response to notices, and we terminate the accounts of repeat infringers in appropriate circumstances.
12. Third-Party Services and Links
The Services depend on third-party services, including Google sign-in, Cloudflare Turnstile, Stripe payments, and our hosting and email providers, whose own terms may also apply to you. Reports link to websites run by others, which we do not control and are not responsible for. Features that depend on third parties may change or become unavailable.
13. Suspension and Termination
You can stop using the Services and delete your account at any time from your settings. Deleting your account cancels any paid plan at the end of the current billing period without a refund for the remaining time, and the reports you unlocked and any remaining unlocks are removed with your account.
We may suspend or terminate your access if you violate these Terms, if your account is involved in fraud or abuse, or if required by law, and we may modify or discontinue the Services or any part of them. Provisions that by their nature should survive termination, including Sections 9 and 14 through 18, survive.
14. Disclaimers
THE SERVICES, INCLUDING ALL REPORTS, SCORES, ESTIMATES, AND DATA, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any report or estimate is accurate, complete, or current.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIET WINNERS AND FOREMIND, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, INCLUDING LOSSES FROM DECISIONS YOU MAKE BASED ON THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless Quiet Winners, Foremind, LLC, and their officers, employees, and partners from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or content from them, your breach of these Terms, or your violation of any law or the rights of a third party. We may assume the exclusive defense of any matter you must indemnify, and you agree to cooperate with our defense.
17. Dispute Resolution: Arbitration and Class Waiver
Please read this section carefully. It affects your legal rights.
- Talk to us first. Before filing a claim, email support@quietwinners.com with a description of the dispute. Most issues get resolved this way. If we can’t resolve it within 30 days, either side may proceed as described below.
- Binding arbitration. Any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (available at adr.org), instead of in court. Hearings will be held by videoconference or in the county where you live, as those rules provide. The Federal Arbitration Act governs the interpretation and enforcement of this section. Either side may instead bring an individual claim in small claims court, and either side may seek injunctive relief in court for intellectual property infringement.
- Class action waiver. Disputes will be resolved only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of class proceeding.
- Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing us with your name and account email and stating that you opt out of arbitration. Opting out does not affect any other part of these Terms.
If the class action waiver is found unenforceable as to a particular dispute, then this entire Section 17 (other than the small claims and intellectual property carve-outs) is void as to that dispute, which will proceed in court, not in a class, consolidated, or representative arbitration. If the AAA is unavailable to administer an arbitration, the parties will select another consumer arbitration administrator or, failing agreement, proceed in court. The rest of this section is severable, and this section survives termination of these Terms.
18. Governing Law, Changes, and Miscellaneous
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles (the Federal Arbitration Act governs Section 17). We may update these Terms from time to time; we will notify you of material changes by updating the date above and, where appropriate, by additional notice such as email. Continued use after changes take effect constitutes acceptance.
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Quiet Winners about the Services. We may assign these Terms to an affiliate or in connection with a merger or sale; you may not assign them without our consent. Our not enforcing a provision is not a waiver of our right to enforce it later. If we provide a translation of these Terms, the English version controls in case of any conflict.
